​Balance Legal Capital is a member of the Association of Litigation Funders of England & Wales and is a signatory to the self-regulatory body's Code of Conduct. 


Established in 2017, Balance's litigation funding business invests in commercial disputes at all stages of the litigation and arbitration process. 

Set-up by former Herbert Smith Freehills lawyer, Robert Rothkopf, Balance Legal boasts an impressive team of legal professionals with considerable expertise and knowledge of commercial litigation and litigation funding generally.

KEY POINTS TO CONSIDER

  • Claim must have a strong prospect of success
  • Provable damages must be at least £3 million
  • Likely costs to full adjudication do not exceed 10% of provable damages (i.e. if damages awarded at trial are £5 million, the legal costs to fund the litigation must be estimated not to exceed £500,000)
  •  Balance's return is generally calculated as a proportion of any proceeds ultimately recovered and is based on the risk-profile and likely duration of the claim.
  • Balance do not interfere with the conduct of the case or make decisions about whether to settle the claim
